In all likelihood the gun would be real but firing blanks. It seems that if it had repeatedly misfired, a blank may have shed part of its casing which then lodged in the barrel. Firing a consecutive blank then turned the shed casing into a projectile which killed the DoP, passing through her and hitting the Director.

On set the Armorer is always responsible for any weaponry but in this incident I read that an Assistant Director handed the gun over and called it "Cold", which means ready and safe. What the hell an AD was doing in charge of a gun I have no idea but a guns chamber and barrel are always checked by any half-decent Armorer to ensure such a situation does not occur.

It also seems, as Dumbo alludes to, that the production was plagued with long hours and much dissatisfaction on set. Whichever way it goes it does not bode well and there is one hell of a lawsuit coming down the line. Truly tragic and even worse, easily avoidable.

Apparently an assistant handed him the gun and said it was 'cold', meaning it was safe to use... Hmmmm.
