We were also told there was an nda before Christmas. I'm still not sure why that would stop people from knowing the names of potential bidders. From my small although real experience, every nda in a company purchase was more to do with the target company's finances rather than the names of bidders. In fact, if you were looking to raise funds to make an acquisition or to do any research, it would be borderline impossible to not disclose your target to so many people it would make the nda impossible to either sign or enforce. Yet that one was swallowed wholesale by the 'financial experts'.

There has certainly been a lot of people confusing NDAs with gagging orders/injunctions. Only those who sign up to an NDA are bound by it.
Exactly. Even if anyone did sign it, it would leak a hundred different ways. Then if it did, as you said, anybody else could disclose the names. It didn't stop the athletic after all.
This has just been a way for certain people - including journalists - to pretend they know more than they do, but can't 'legally' tell us what they know. As far as I'm concerned anyone that used this excuse is at best 'exaggerating' their 'in the know' knowledge.
